Kost v. Kost 63 A.D.3d 798 (2nd Dep't 2009)
The Appellate Division reversed the trial court's award to the husband of only 14.63% of the appreciation in value of the former marital residence which was the wife's premarital (separate) property and awarded the husband 50% of the appreciation in value of said residence. Howard represented the husband at both the trial and at the appellate level.
Lichtman v. Martin's News Shops 81 A.D.3d 696 (2nd Dep't 2011)
The Appellate Division reversed the lower court's denial of the defendents' motion for Summary Judgment in an age discrimination and Fair Labor Standards Act case, granted the defendents Summary Judgment and dismissed the plaintiff's case. Howard represented the defendents in both the lower court matter, and at the appellate level.
